MUNICH, Germany -- German prosecutors said Monday they wont appeal against Uli Hoeness 3 1/2-year sentence for tax evasion, clearing the way for the former Bayern Munich president to start his prison term. Hoeness, one of German footballs most prominent figures, was convicted last Thursday of evading about 28.5 million euros ($39.6 million) in taxes via an undeclared Swiss bank account. He subsequently said he wouldnt appeal and resigned as Bayern president. Prosecutors also are entitled to appeal in Germany and could have sought a tougher sentence. At the trial, they called for a 5 1/2-year sentence; the legal maximum for tax evasion is 10 years. But Munich prosecutors have decided not to appeal, the court said. Hoeness is now likely to go to prison in a few weeks. Germanys opposition Left Party criticized the prosecutors decision, saying it could prevent further details of Hoeness financial dealings from coming to light. As evidence came out during last weeks trial, the amount of tax Hoeness is said to have dodged increased by the day from the 3.5 million euros he was initially charged with. That raised questions of where Hoeness, who also co-owns a sausage factory, got the millions he claimed to have used to speculate on the currency markets. "Now many questions will remain forever unanswered," Left Party chairman Bernd Riexinger told German daily Handelsblatt. Bayern should put in place an independent panel to investigate whether there was any link between Hoeness money and the club, he said. Hoeness has insisted the account was in his name only. DENVER - Less than a week removed from a 51-point coming out party, Terrence Ross was at it again. Ross had 16 points midway through Fridays game in Denver, connecting on six of his seven field goal attempts, none more memorable than his final bucket of the half. The Raptors guard picked off a pass from Kenneth Faried - one of the Nuggets 26 turnovers - and proceeded to go the length of the floor before throwing down one of the more emphatic one-handed dunks youll ever see directly over the defending Manimal. SALT LAKE CITY -- Derrick Favors is a difference-maker, rusty or not. Favours returned from a hip injury and set the tone early on his way to 20 points to help the Utah Jazz beat the Boston Celtics 110-98 on Monday night. "I felt rusty to tell you the truth but it felt good to be back out there. I made a lot of open shots and I think I did a good job defensively to help my team win," Favors said. Utah coach Ty Corbin was glad to see Favours back on the court. "He does so many good things for us on the defensive end, it really makes it easy for the other guys," said Corbin, whose team is 0-9 without his star centre. In the games Favors has missed, its easy to see the Jazz struggle to defend. Even the soft-spoken big man can see the void when hes on the sidelines. "They are a step slow on the defensive end. Usually Im the only guy who helps out when guys make mistakes. Im the guy who bails them out," Favors said. On the offensive end, Alec Burks is the guy who bails out the Jazz when the play breaks down or the shot clock nears zero. TSN Baseball Insider Steve Phillips answers three questions each week. This week, topics cover the Blue Jays rotation, the futures John Gibbons and Alex Anthopoulos, protecting pitchers and a bonus question on his predictions for the MLB playoffs. 1) With J.A. Happ heading to the DL, the Toronto Blue Jays have announced a starting rotation of R.A. Dickey, Drew Hutchison, Mark Buehrle, Brandon Morrow and Dustin McGowan. Should the Blue Jays feel confident with that group or even this early in the season, should they be looking outside the organization for an upgrade? Or should they have kept a prospect like Aaron Sanchez or Marcus Stroman with the big club? The Blue Jays are starting the season with exact rotation they should be using. Aaron Sanchez and Marcus Stroman both need more development but at some point they may be called upon to help. Certainly there are big questions for three-fifths of the starters but there is definitely upside. RA Dickey is just a year removed from his NL Cy Young Award and is predictable and dependable. I cant believe I am saying that about a knuckleballer but it is true. Mark Buerhle is a more than serviceable innings-eater who gives his team a chance to win start after start. After these two though the questions are significant. Brandon Morrow has suffered injuries in each of the past two seasons after looking like a number one starter at times in 2012. Dustin McGowan is throwing in the mid-nineties and is working on a curve ball to go with his devastating slider, but he has thrown just 46 2/3 innings since 2008 because of recurrent shoulder injuries. Drew Hutchison hasnt pitched in the Major Leagues for the past year and a half due to Tommy John surgery but prior to that he looked like he could be a long-term answer for the rotation. Before the season begins players, front office personnel and fans close their eyes and dream about what could be. I can close my eyes and see RA Dickey commanding his dancing knuckler that will baffle hitter. I can envision Buerhle getting a ton of grounders and working quickly getting the powerhouse offense back in the dugout and scoring a ton of runs. I can picture Brandon Morrow rifling his fastball by the games biggest sluggers and logging a ton of strikeouts. I can imagine McGowan and Hutchison fulfilling the potential that they once had as well. It could happen just that way. But it probably wont. My experience is that the more questions you enter with the more things that will likely go wrong. There is a bunch of unpredictability in this rotation. Depth will be important. It is safe to assume that health will be an issue at some point because it has been an issue in the past. Esmil Rogers and Todd Redmond may make starts if necessary. But Alex Anthopolous is going to have to keep working the phones to look for upgrades. Early in the season other clubs arent typically trading good pitchers but he will need to be ready for when they do become available. So when you close your eyes and dream just hope it is not a nightmare. 2) Is manager John Gibbons on the hot seat with the Blue Jays? If the team is slow out of the gate again this year, will he be replaced? Are his and Alex Anthopouloss future tied together (if one goes, the other follows him out the door)? I dont think John Gibbons is on the hot seat during the season this year. I know there were big expectations last year but the collapse wasnt Gibbons fault. The starting rotation just fell apart on him as Morrow and Josh Johnson got hurt and Ricky Romero imploded. Jose Reyes injury crushed the offense early in the season and more injuries followed. The expectations are less this year than a year ago. It certainly behooves the Jays to get off to a good start so they can start to believe in themselves but Gibbons cant pitch for his team and the staff will be the key. I have never been a believer that managers and general managers are tied at the hip. The manager needs to look at the GM as his boss. Clearly Gibbons was brought back to the Jays because of his relationship with Anthopolous but if Anthopolous thinks a change needs to be made he will have to make it. If ownership gets to a point where they believe the roster is flawed and they decide to make a decision on the general manager it is unlikely Gibbons would survive a change in regime. Anthoplous can possibly survive the firing of Gibbons but I dont believe Gibbons would survive the firing of Anthopolous. As it stands today both the manager and general manager are on firm ground as they should be. They just need to be honest with themselves and their bosses about what the expectations are with the roster they have. The owners can hope to be competitive in the tough AL East but if they expect to win it then both Anthopolous and Gibbons are in trouble. This is a roster for which you can hope but not expect great things. 3) With Reds starter Aroldis Chapman and Rays starter Matt Moore both being hit in the head by comebackers to the mound in spring training, is it time for Major League Baseball and/or the players union to implement mandatory pitcher protection? It seems that pitchers have become more and more vulnerable over the past few seasons. Fortunately, we have avoided major catastrophe but we shouldnt be shocked if a pitcher were to be killed by a hit ball. We have just been lucky so far. I am a firm believer that we should never wait for someone to be killed to make a change. Baseball already did that once. Base coaches wear helmets now because a minor league first base coach was hit in the head by a line drive and killed. If protecting pitchers is being considered then protect them. Lets not wait for a tragedy. It is currently optional for pitchers to wear the new protective headgear that was developed by MLB for this year. The feedback so far is that the hats look funny and are not overly comfortable. MLB needs to keep refining the protective hats to make them functional. This needs to be a priority for the Players Association as well. Protective hats for pitchers need to be made mandatory at the minor league level initially. Let the kids get comfortable with them so by the time they are big leaguers it is commonplace. Once the hat is advanced enough make it mandatory for major league pitchers to wear. There is no clock in baseball but we need to put a clock on this. Every pitch thrown puts a pitcher at risk. Please hurry. 4) With the second and third opening days approaching for Major League Baseball it is time to make predictions. The French defender looks a good fit for Pep Guardiolas Etihad Stadium revolution, writes Nick Wright. Pep Guardiola counts Argentine manager Marcelo Bielsa as one of his biggest influences so perhaps it is not surprising that he shares his idols admiration for Aymeric Laporte. The French centre-back was schooled by Bielsa as a teenager at Athletic Bilbao, and Guardiola is eager to continue his education at Manchester City next season.Sundays 2-2 draw with Arsenal showed why the incoming manager has identified central defence as Citys most pressing area in need of attention. This season they have conceded more Premier League goals (40) than in any of the previous five, with Nicolas Otamendi and Eliaquim Mangala struggling to meet expectations and Vincent Kompany repeatedly falling victim to injuries. Major changes are required, and while Evertons John Stones is among the names to have been talked up, Laporte appears to be the priority for Guardiola. Citys sporting director Txiki Bergiristain has already flown to Bilbao to discuss the deal with Athletic, and reports in Spain suggest City are ready and willing to pay his £39m buy-out clause. Laporte on City rumours Aymeric Laporte denies he has agreed to join City but Sky sources confirm he is a target. The team finished fourth in La Liga and qualified for the Champions League. Laporte was part of the spine of the team and became the líder of the defence. He was still 19 but no one disputed it despite his age. He’s fast, he has character, he is competitive, he has very good technique and he is very intelligent. Marcelo Bielsa on Aymeric Laporte in 2015 Laporte is an accomplished one-on-one defender who doesnt shy away from physical challenges, but he prefers to rely on his fine reading of the game and intelligent positioning rather than gung-ho tackling. He has an excellent range of passing and averages more per game than any other Athletic player with the exception of central midfielder Beñat, while he is also a goal threat, having scored five times this season alone before he was injured in March.As for weaknesses, there is little to cause alarm. In some games you can still see his youth and inexperience, says Río. There have been some errors and he has been sent off for inexperienced fouls, but with time he has got better. You can see that he learns very fast for a player so young, and its not surprising that some of the biggest clubs in Europe want him. Hes young and he has to improve some things but hes already the real deal, he said in October. He is a player who is mature, despite his youth. Experience is always important, but if you already have that experience when you are 22, then imagine…Laportes rare combination of technical ability, physical prowess and youthful experience has thrust him to the forefront of Manchester Citys plans. Much has been written about Jose Mourinhos evolution at Stamford Bridge this summer and it is clear the additions of Fabregas and Costa, coupled with a full season of Matic, have made them far more dangerous than last campaign. There is no reliable sabermetric statistic in this sport that shows ones value over another like in Major League Baseball, for example, but you dont have to be into analytics to understand that Chelsea are much stronger this season and will absolutely finish it with more than the 82 points they ended with in 2013-14. Reigning champions Manchester City didnt go through the same overhaul as Chelsea. After all, they felt less inclined to make changes after winning the title with 86 points. However, the continued rise of Mourinhos men suggest City need to be better than last season if they want to regain the Premier League title for the first time. Simply put, 86 points wont get it done and this years team needs to find a way to be better than the one that scored 102 goals last season. Its a formidable task set by the deep pockets of Chelsea owner Roman Abramovich. So how do City improve from last season? One obvious area is in goal. Last season, City would have had more points if it wasnt for the individual errors that plagued Joe Hart, particularly the one at Chelsea in the final minute which handed Chelsea two more points and took away one from themselves. A three point swing that would have meant they beat Chelsea by seven points last season and not four. This season, Hart seems a little must self-assured and so far hasnt cost his team points. City, however, are far from their best at the moment. The form of Toure has rightfully been questioned but the overall balance of the midfield has yet to be found with manager Manuel Pellegrini trying a number of different combinations so far. Slow starts are not unusual from champion teams. The transfer window and two international windows being open through the first two and a half months of the season can lead to disjointed performances. It happened to City last season; gaining just 16 points through the first eight matches (two points per game) before going to raise that average to a far more impressive 2.33 PPG for the final 30 matches. This season they are on 17 points through the first eight games having already played Liverpool, Arsenal, Chelsea and Tottenham -- four of the top six from last season. Last year they had only played one of the previous seasons top six through eight games (a vastly underperforming Manchester United), despite only reaching 16 points. It is clear, then, that City are on a path of improvement and the main reason for that has been Aguero, who against Tottenham on Saturday showed that he has the ability to swing the momentum their way in matches. A crucial trait in a winning team is to have the ability to dig deep when the opposition is having their moment in the match and when a difference maker like Aguero is fit he can do that with goals out of nothing, much like he did with goals number one and four against Spurs. When he is fit, City are a different side and he also gives them tactical versatility because he is equally dangerous in a front two or leading the line by himself. This season he now has nine Premier League goals in 527 PL minutes. That is a goal every 58.5 minutes. He has played the best part of 110 hours of Premier League football in his career and now has 61 goals. That gives him a goal every 108 minutes at that level, the best in the 22-year history of the Premier League. Yet we still want more. The goal scoring numbers are incredibly impressive but one number that is concerning when it comes to Aguero is the amount of games started. In his first season at the Etihad, he started 31 games and scored 23 goals. In 2012-13 he started just 22, scoring 12, and last season he started 20, scoring 17. Starting 42 games in the last two seasons combined is not enough and some of those matches came when he was far from healthy. Whenever the Argentine is seen grimacing on the field, City fans rightfully get very concerned. Just think how much better Argentina would have been at the World Cup had he been himself. Man City may have some consistency issues with Toure and their midfield at the moment but they do have their real talisman back. If they can keep their 26-year-old star striker on the field to start more than 30 league games this season then that will be the biggest contributor to their improvement. A healthy Aguero can be the difference City need to stop the Chelsea juggernaut. He is a player the Premier League is lucky to have, their best of all when truly himself. All of the video replays we were shown on TV were inconclusive about whether the puck had entirely crossed the line or not. Neither ref made an attempt at blowing the whistle or pointing at the net and no call was made on the play as it was sent right to the video replay judges. Only after the replay was reviewed was the goal allowed to count. Paul Devorski told Coyotes coach Dave Tippett that he was sure it was a goal. If Devorski was so confident it was a goal then why didnt he signal a goal and blow the whistle? Why did he send it to the video replay? Their indecision and explanation do not seem to match up. Understandably, they appeared uncertain and indecisive as they searched to find the puck from underneath Smiths pads. The puck did not become visible until Smith wisely and carefully manipulated his pads from inside the net and kicked his feet forward until the puck appeared well out in the middle of his goal crease. Since no signal was made by either referee as required, I must assume they did not and could not see the puck across the goal line. As such, they were unable and unwilling to make an initial call. The only alternative for Martell and Devorski at this point was to pass the decision upstairs to video review which has become the safety net for the official. Video review rendered an inconclusive verdict since no camera angle was available to clearly demonstrate the puck crossing the goal line due to the obstructed view from Smiths pads! The call then reverted back to the referee(s) on the ice for a final decision. Referee Rob Martell was on the head set throughout the video review process. The referee was either provided with input and assistance from upstairs and/or Martell used common sense and logic to deduce that since the puck was under Mike Smiths pads and Smiths pads were across the goal line a legal goal should be counted. I agree with the referees ultimate decision in that it is most logical and probable that the puck completely crossed the goal line. I have personally stood on the goal line and signaled a goal when the puck was caught by the goalkeeper with his glove across the line and then pulled his glove and the puck forward out of the net. The puck was in the glove and the glove was across the goal line and inside the net. I also counted goals when the goalkeeper carried the puck across the line and into the net. I made these decisions immediately and without hesitation. There was no video review to act as a safety net. Even when the review process was implemented I wanted to see the play and make the call. - This very late decision by the on-ice referee Thursday night following video review highlights at least two flaws in the current system. The first is that two different standards can be applied in determining goals. Video review must clearly see the puck across the goal line with an unobstructed view before they will verify a goal. The evidence must be unequivocal! If this cant be achieved video review personnel render an inconclusive verdict even in cases where it appears logical that the puck would have crossed the line. - The referee, on the other hand, as we saw demonstrate on this call, allowed a goal to stand by applying logic, common sense and the power of deduction to determine that in his judgment the puck had crossed the goal line. My recommendation is to provide the referee with the authority to review controversial goals at ice level (including goalkeeper interference) and have the final authority and judgment in these matters. The optics on JVRs ultimate goal determination looked ridiculous! Referee Martell (and Devorski) did not make a decision on the play in real time. Martell then spent several minutes communicating through a head set and staring into space. Following the inconclusive review verdict, Referee Martell was forced to render a final decision - one that he was unable or unwilling to make in real time! The Refs are supposed to make a call one way or the other in real time; let them also make the final decision through the video review process, As Referee Rob Martell demonstrated Thursday night, thats in their job description and what they get paid to do! PORTLAND, Ore. -- Houston has a LaMarcus Aldridge problem. The Trail Blazers All-Star forward has been dominating with more than 40 points in each of the opening two playoff games with the Rockets in Houston. Portland is up 2-0 as the series moves to Rip City on Friday night, giving the Rockets little time to figure out how to defend Aldridge. He opened the playoffs with a franchise post-season-best 46 points in the Blazers 122-120 overtime victory, then followed it up with 43 points in the 112-105 win on Wednesday night. Rockets coach Kevin McHale summed it up best when he said: "So far, hes had a hell of a series." Aldridge found success in the paint in the opener so the Rockets adjusted -- but so did Aldridge, who went outside to pepper Houston with midrange jumpers. Thirteen of his 18 field goals came from 10 feet out or more. "Hes making tough shots, hes getting to the foul line. Hes offensive rebounding. A person with knowledge of the deal also confirmed late Monday night that the Giants have reached an agreement with former Denver Broncos kick returner Trindon Holliday. The person spoke on the condition of anonymity because Holliday has to pass physical Tuesday before the team will announce the move. Holliday returned a punt 81 yards for a touchdown in the Broncos 41-23 win over the Giants in the second week of last season. The deals come just a day after the Giants confirmed the signing of former Seahawks cornerback Walter Thurmond and Chiefs safety Quintin Demps. Rodgers-Cromartie and Prince Amukamara are probably penciled in as the starters at cornerback, with Thurmond, Jayron Hosley and Trumaine McBride backing them up. "Honestly we played as aggressively as we have been. "That has nothing to do with why our production is down. Its up to us to play like we can."
